Seems that he could possibly avoid the death penalty if he pleads guilty in his current case and agrees to drop his appeal in his first case. He could still face the death penalty in other future cases, but I'm betting they would abide by this plea agreement.
I personally think that he should've never faced the death penalty and certainly shouldn't have to give up his appeal rights in his first trial.

If I'm not mistaken this is the minor that was charged with the sniper shootings right? Considering he was a minor and that he was being cohersed by an adult I have to agree with you that he should not be facing the death penalty. I'm not up to date enough on what exactly happened (like who was pulling the trigger) so I'd need to read more in to it.
